Workforce restructures in NSW: what the law requires, and what good support looks like

A statutory payment and outplacement support are not the same thing and confusing the two is one of the most common gaps we see in NSW restructures.

What the Fair Work Act requires: When a role is eliminated, the National Employment Standards set a minimum payment ranging from four weeks (1–2 years' service) to sixteen weeks (9–10 years' service). It's a payment. It isn't support finding the next role.

Where NSW differs: unlike Victoria, NSW never referred its public sector industrial relations powers to the Commonwealth. NSW public sector employees sit under the Government Sector Employment Act 2013 rather than standard NES rules, often with more generous terms through enterprise agreements, and the Industrial Relations Commission of NSW handles state-system disputes rather than the Fair Work Commission.
